Zusammenfassung

Datenteilen im Bauprozess in Common Data Environments (CDE) ist bisher durch die DIN EN ISO 19650 erfasst, die keine expliziten Vorgaben zur rechtlichen Organisation der technischen Infrastruktur macht, sondern eher auf die Prozesse abhebt. Dies ändert sich mit der Verabschiedung des europäischen Data Governance Act (DGA) am 30.05.2022, der als direkt wirkende Verordnung die gesetzliche Trennung des Anbietens von Daten und Services vorsieht. Bestehende Geschäftsmodelle zum Datenteilen in der Baubranche sind auf ihre Rechtskonformität zu überprüfen und ggf. anzupassen. Der Beitrag will zeigen, wie das Datenteilen nach Erlass des DGA in einem CDE im Bauprozess rechtskonform möglich sein kann und nimmt dabei insbesondere auf das Teilen von Daten im Rahmen der BIM-basierten Planung Bezug.

Abstract

Data sharing within the construction process in a Common Data Environment (CDE) has been treated by DIN EN ISO 19650. While the norm mainly deals with the process management within a CDE, it does not cover any legal requirements due to the organization of the technical infrastructure. The European regulation of the Data Governance Act (DGA) of 30 May 2022 changes the legal situation fundamentally. The DGA stipulates the separation of data sharing and data services with regard to the data use. Existing business models for data sharing in the construction business have to be checked for legal conformity and might have to be changed. The paper introduces proposals how data sharing according to the DGA could be organized within the construction process. Hereby, it focuses particularly on data sharing for BIM-based planning.
